1. Company information

In these Terms, “Momenti”, “we”, “our” or “the platform” means Luxera Gift LLC, and “shop” means a seller registered on the platform.

2. Nature of the platform (important)

momenti.ge is an advertising and catalog platform that showcases the gifts of independent shops and connects them with potential buyers.

Momenti does not sell products itself. Any purchase is made directly between the buyer and the relevant shop.

  • Momenti is not a party to the sale and is not involved in the transaction;
  • Momenti does not process payments and does not provide delivery/courier services;
  • Prices, stock, product quality, offers, delivery and service are entirely the shop's responsibility.

3. Accounts

  • Buyers do not need an account — browsing gifts and contacting shops works without registration;
  • Only shops create accounts, to list and manage their gifts;
  • A shop is responsible for keeping its account credentials confidential and for all activity on its account;
  • Momenti may suspend or close an account for false information, abuse, fraud or breach of these Terms.

4. Shop obligations

The shop is solely responsible for its listings and its dealings with buyers.

  • Provide accurate, non-misleading information about products, prices and availability;
  • Ensure product quality, conformity and fulfilment of commitments to the buyer;
  • Independently handle payment, delivery, warranty, returns and refunds with the buyer;
  • Comply with applicable Georgian law, including consumer-protection rules;
  • Not list illegal, prohibited or rights-infringing products or content.

5. Prices, payment and delivery

  • All prices are set by the shop and shown in Georgian Lari (GEL) unless stated otherwise;
  • Payment and delivery happen directly between the buyer and the shop on terms they agree;
  • Momenti does not take payment for products, does not store card data and is not responsible for delivery;
  • Any dispute about payment or delivery is resolved directly between the buyer and the shop.

6. Advertising services and fees

Momenti offers shops listing and boost (promotion) advertising services.

The fees and terms of advertising plans are shown on the platform and may be updated from time to time. Service may be free during the launch period.

The free plan allows publishing up to 5 gifts. Unlimited publishing requires a paid (VIP) plan.

Once an advertising plan is activated, payment is final and the subscription cannot be canceled. The plan is valid for 1 month from activation and automatically turns off when it expires, with no automatic renewal.

When a paid plan expires, if the shop has more than 5 published gifts, the system keeps the 5 most-viewed gifts visible and hides the rest. The shop can then choose which 5 to publish.

7. Limitation of liability

  • The platform is provided “as is”, without warranty of uninterrupted or error-free operation;
  • Momenti is not liable for the transaction between a shop and a buyer, for product quality, payment, delivery or returns;
  • Momenti is not liable for the accuracy of information posted by shops;
  • To the extent permitted by law, Momenti's liability is limited to the advertising fee paid by the relevant shop.

8. Intellectual property

  • The platform design, logo, software and original content are the property of Luxera Gift LLC;
  • Images and text uploaded by a shop remain the shop's responsibility; the shop warrants it has the right to use them;
  • Any unauthorized use, copying or distribution of the platform is prohibited.

9. Prohibited use

On detecting abuse, Momenti may restrict or terminate access.

  • Using the platform for unlawful purposes;
  • Interfering with the operation or security of the website;
  • Posting false, offensive or misleading content;
  • Infringing the intellectual property or privacy rights of others.

10. Third-party links and content

The platform may contain links to shops' or third-party websites (e.g. social networks).

Momenti is not responsible for their content, policies or services.

11. Governing law and disputes

These Terms are governed by the law of Georgia.

The parties will try to resolve disputes by negotiation; failing that, disputes are heard by the courts of Georgia.

12. Changes to the Terms

Momenti may update these Terms at any time by publishing a revised version on the platform.

Continued use of the platform means acceptance of the updated terms.
